Conflict of Interest and Confidentiality for Conveyancers

This module looks at the issues of conflict of interest and confidentiality in relation to conveyancing transactions and comprises notes adapted from the Law Society of Scotland's ('the Society') practice guidelines on these questions with a number of problems to be answered. These are all anonymised versions of real enquiries received by the Society's Professional Practice Department in recent years. Some of the problems are straightforward, and others might need a bit more thought.

There is a reference page with links to more information on the Society's website such as the relevant practice rules and the 'Code of Conduct for Scottish Solicitors'.

This module qualifies for 1 hour (Management) CPD.

Conflict of Interest and Confidentiality for Conveyancers Far more realistic than other online CPD courses I have done (about 4 0r 5). However the software is clinky and it took two tries to get past the early questions. The round-up at the end is a mixture of questions supported by text, and questions with no context whatsoever. (I still got 100%!)

Conflict of Interest and Confidentiality for Conveyancers Good with relevant examples. Surprised that conflict arises where two connected clients (both established) reaching agreement inter se (in writing) for the division of sale proceeds before instructing solicitor and neither having asked for or receiving advice, and declining (in writing) his request that they should get separate representation: an execution service only. Where is the conflict and if there is one what comebacks could there be if the solictor acts for them both and carries out their written instructions to the letter (always assuming that there is nothing obvious questionable about the instructions)?.
