This course looks at the issues of
conflict of interest and confidentiality in relation to court matters, both
civil and criminal, and comprises notes adapted from the Law Society of
Scotland’s (‘the Society’) Codes of Conduct and practice guidelines on these
topics with a number of questions to be answered. These are anonymised versions
of real enquiries received by the Society’s Professional Practice Department in
recent years. The problems offer multiple answers, and picking the correct
answer will allow you to progress to the next section of the course. Some of
the problems are straightforward, and others might need a bit more thought. There
is a reference page with links to more information on the Society’s website,
such as the relevant practice rules, the ‘Code of Conduct for Scottish
Solicitors’ and the ‘Code of Conduct for Criminal Work’.
